Still Schedule I — Rescheduling Ordered But Not Yet Done
Executive Order 14370 (December 18, 2025) directs the U.S. Attorney General to expedite rescheduling cannabis to Schedule III of the Controlled Substances Act. As of May 2026 the rescheduling process remains incomplete and cannabis is still federally prohibited. Moving to Schedule III would not legalize cannabis federally, but would remove the harshest restrictions and open doors for banking, research, and tax relief for cannabis businesses.
